Our Products
We strive to offer quality products at bargain prices. Our product selection covers a wide variety of categories. All products are new unless otherwise noted in the product's description. All new products carry the manufacturer's warranty. Used products are guaranteed by us to arrive in the condition as described in the "product description". Quantities of some products are limited. Sometimes, a hot product may "sell out" before it can be removed from our site. If you order such a product, you will be notified via email that it is on backorder or has been discontinued. As always, your satisfaction is most important to us. Any payment we have received for discontinued products will be promptly refunded and payment for backordered items will also be refunded, if desired, instead of waiting for the backordered item to arrive.
 
Our Guarantee
The following applies only for returnable products. Some products (for example, some perishable items) are not returnable. If a product is not returnable it will be noted in the product's description or on the sales receipt.

If a new product arrives defective or if a used product arrives and is not in the condition "as described", you may return it within 30 days from the date it was shipped to you. For such products, at ABN's discretion, you will be given a full refund or exchange or in a few cases, the product may be repaired. If a new product arrives and it is not defective but you are not satisfied with it, or if a used product arrives in the condition "as described" but you are not satisfied with it, simply notify us within 10 days after you receive it and you will be given a refund (less shipping and handling costs). Before returning any items, you must notify us via email to obtain return authorization. Please also read the "Returns" section for items that are not included under the returns policy discussed above.
 
Payment Methods
We accept credit cards or e-checking account payments through PayPal. We also accept payment by check or money order. All prices are in U.S. funds. No items can be shipped until payment is received. If you were not able to pay for your order at checkout, login to your PayPal account (PayPal), go to the "Send Money" tab. Enter "sales@americanbargain.com" in the "Recipient's Email" field. Enter your order amount in the "Amount" field. Enter your order number in the "Subject" field, click the "Continue" button then click the "Send Money" button. That's all there is to it.
 
Shipping
We ship anywhere in the United States (and around the world for certain items). You can select any of the shipping methods shown during checkout. This usually includes numerous USPS or UPS shipping methods. You can also specify any insurance that you would like included. Items usually ship within 24 hours of receiving payment except weekends and holidays. Any backordered items will ship as soon as they become available. You will find that USPS First Class is probably the best rate for shipping items under 1 pound and the UPS Ground rate is usually better for larger items. Please note: UPS will not ship to PO/APO/FPO addresses. However, certain items can be shipped to PO/APO/FPO addresses via USPS Priority Mail. During checkout, you will be asked to either change your "ship to" address or "shipping service" if a service that does not support that type of address has been selected.

ABN reserves the right to substitute a shipping method in place of the shipping method selected during checkout. If a shipping method substitution is made, an additional charge may be added or... if the substituted rate is lower, a refund will be issued. ABN will always attempt to substitute with a "comparable" shipping method, where "comparable" means advertised delivery times within 12 hours of each other.

If after 20 business days (6 weeks if international order) your shipment has not arrived, please contact our customer service department. Shipping delays may occur over holiday periods.
 
Returns
We strive to offer top quality new and used products. If an item arrives defective or is not "as described", return it within 30 days of the original ship date and we'll replace the product or refund the amount you paid for the item including a credit for the original shipping cost and a credit for lowest rate return shipping. Items must be returned in their original packaging (including any users manuals and accessories). Note: This return policy does not apply to items whose return policy is described separately such as software, computers and monitors. New software titles can be returned only if they are still sealed in their original packaging. If a new software title is defective, you will need to contact the manufacturer to obtain replacement media (i.e. diskettes, CD, etc.). Computers and monitors can be returned (in their original packaging) to us only if there is a hardware defect and we are notified within 10 days of delivery. For computer or monitor issues after 10 days of delivery, you will need to contact the manufacturer to obtain warranty service. Certain returned items may be charged a restocking/handling fee. International returns will be handled on a case-by-case basis.

All returns must not be shipped until you email customer service and receive an email reply approving the return. Any item returned without prior approval will not be accepted.

If merchandise arrives damaged, it is best to REFUSE it back to the carrier attempting delivery. If you accept the package, make sure it is noted on the carrier's delivery record in order for you to file a damage claim. For return packaging, save the original box and the packing material in which the merchandise arrived. ABN must be notified of damaged goods. If ABN isn't notified of damaged goods within the first 10 days of arrival, then ABN will not accept the return under the "damaged item" terms of our regular return policy and manufacturer restrictions may also apply.
 
Special Notes
For gift basket purchases, chocolate cookies will be substituted for traditional chocolates during summer months. Based on availability, a basket might be a little lighter or darker than its photograph. Also, based on availability, similar food brands/products may be substituted but the quality and value will not change.
 
Sales Policy
PLEASE READ THESE TERMS AND CONDITIONS OF SALE ("SALE AGREEMENT") VERY CAREFULLY. USING THIS WEB SITE ("SITE") INDICATES THAT YOU ACCEPT THIS SALE AGREEMENT. The Customer accepts this Sale Agreement by making a purchase, placing an order, or otherwise shopping on the Site. References to "you" or "your" shall relate to the Customer also referred to as the Purchaser; references to "ABN" shall relate to ABN and its affiliates. The terms and conditions of this Sale Agreement are subject to change without prior notice, except that the terms and conditions posted on the Site at the time the Customer initially places or modifies an order will govern the order in question. This Sale Agreement constitutes the entire agreement between the Customer and ABN relating to the purchase or sale of goods or services on the Site. The Sale Agreement may only be modified or terminated with regard to goods or services that have been purchased or sold on the Site in writing and signed by ABN. Electronic records (including signatures), that are otherwise valid, shall be accepted under the Sale Agreement. In the event of any confusion concerning the sales terms and conditions, you agree that the provisions of this Sale Agreement and our invoice shall control.
  • GOVERNING LAW: THIS AGREEMENT AND ANY SALES HEREUNDER SHALL BE GOVERNED BY THE LAWS OF THE STATE OF TEXAS, WITHOUT REGARD TO CONFLICTS OF LAWS RULES. THE CUSTOMER CONSENTS TO THE JURISDICTION OF THE FEDERAL OR STATE COURTS LOCATED IN HARRIS COUNTY, TEXAS FOR PURPOSES OF ANY SUIT, ACTION OR PROCEEDING ARISING OUT OF THIS SALE AGREEMENT.
  • TITLE; RISK OF LOSS: Title to goods herein being purchased is retained by the seller until goods are paid for by the purchaser and at that time title passes to the purchaser. Loss or damage that occurs by the carrier during shipping will be covered according to the carrier's policies and any shipping insurance that is provided by default and/or that the purchaser has selected. It is the purchaser's responsibility to work with the carrier to resolve all issues.
  • EXPORT SALES: If goods herein being purchased are being purchased for purposes of export, the Customer must obtain from the federal government certain export documentation before shipping to a foreign country. In addition, manufacturers' warranties for exported goods may vary or even be null and void for goods exported outside the United States. The Customer should inquire further regarding any questions. ABN assumes no liability for issues arising due to a Customer choosing to export products purchased from this Site.
  • GENERAL LEGAL DISCLAIMER: ABN HEREBY EXPRESSLY DISCLAIMS ALL WARRANTIES EITHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THIS DISCLAIMER BY ABN IN NO WAY AFFECTS THE TERMS OF THE MANUFACTURER'S WARRANTY, IF ANY.

  • ORDERS; PAYMENT TERMS; INTEREST; TAXES: Orders are not binding upon ABN until accepted by ABN. Terms of payment are within ABN's sole discretion. Payment is due within 10 business days of the date of purchase, unless a separate purchase agreement is in place with the Customer (in that case, payment is due according to the terms of the purchase agreement). ABN may invoice parts of an order separately. Customer agrees to pay interest on all past-due sums at the highest rate allowed by law. The Customer is responsible for sales and all other taxes associated with the order. For standard purchases (i.e. no separate purchasing agreement), ABN may cancel orders at its sole discretion if payment has not been received within 10 business days.
 
Privacy
We're committed to you privacy. We never see your payment account information. At checkout, automatic payment is processed using SSL encryption technology via a link to PayPal. Your account information on our site is known by your user ID (email address) and password available only to you.

We will never disclose your personal information to any third party unless legally required to do so. Personal information includes things like your address, phone number and email address.

We may share general (non-personal) information with third parties.
